For more than 30 years, David has represented individuals seeking the benefits they have earned. He handles benefit appeals with the insurance companies, and litigation in state and federal court, both for ERISA employer plans, and private policies and governmental pension plans such as municipal pension and Connecticut State employee pensions and other benefits.
He is recognized as an authority in ERISA employee benefits by other lawyers in the State, having presented many seminars on these issues.
David has worked with employees, executives, and entrepreneurs in negotiating and litigating the employment, non-compete, incentive compensation, severance agreements and equity agreements that determine whether an individual will be able to earn the compensation and other benefits they have earned. Each matter starts with determining the client’s goals, and developing a strategy to achieve those goals, informed by the knowledge of the law and real-world business experience gained in more than 35 years of practice in this area.
David resides in Wilton, Connecticut with his wife, Wendy Kerner, who is a professional harpist. In addition to his ERISA practice, he is an avid amateur trombonist. He has played with Wilton Rocks for Food, the Civic Orchestra of New Haven (Principal), the American Chamber Orchestra in Fairfield, Troupers Light Opera Company in Darien, the Wesleyan Orchestra, the Connecticut College Orchestra, the Oddfellows Summer Children’s Circus of Middletown, the Glenn Hansen Big Band, and other classical, jazz and rock groups around the state. He enjoys cooking and has won blue ribbons at county fairs for his baking
